Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Jazz Air Limited Partnership d/b/a Air Canada jazz, 310 Goudey Drive, Halifax International Airport, Enfield, NS, B2T 1E4, operating under Part VII, Subpart V of the Canadian Aviation Regulations (CARs), from the requirement set out in Subsection 705.127(3) of the CARs, which requires that “an air operator shall retain a copy of the most recent written examination completed by each person for each type of aircraft, where applicable, for which the person has a qualification.”
PURPOSE
The purpose of this exemption is to allow the air operator, Air Canada jazz, to utilize its electronic (paperless) crew record system to track written examination results for its crew members.
APPLICATION
This exemption applies to Air Canada jazz in its operations under Air Operator Certificate Number 6434.
CONDITIONS
This exemption is subject to the following condition:
- Air Canada jazz shall ensure a master copy of any written exam is kept on record for a period of at least three years.
- A copy of this exemption must be kept with the master written examinations.
- A copy of failed exams shall be retained for a period of at least three years.
VALIDITY
This exemption is in effect until the earliest of the following:
- 24:00 Atlantic Daylight Time on October 1, 2006;
- the date on which an amendment to Sub-section 705.127(3) of the CARs comes into effect;
- the date on which any of the conditions set out in this exemption is breached; or
- the date on which this exemption is cancelled, in writing, by the Minister,
where he is of
the opinion it is no longer in the public interest or is likely to affect aviation safety.
EXEMPTION CANCELLATION
The Exemption from 705.127(3) of the Canadian Aviation Regulations (CARs) issued to Jazz Air Limited Partnership d/b/a Air Canada jazz, on March 15, 2005 by Regional Director Civil Aviation on behalf of the Minister of Transport, is hereby cancelled because it is the opinion of the Minister that it is no longer in the public interest or is likely to affect aviation safety.
